Terms of Service

Effective and last updated: October 22, 2026

These Terms govern access to MasteryCue. If a school or district has a signed agreement with us, that agreement controls where it conflicts with these Terms.

Eligibility and authority

You must be legally able to enter a contract and authorized to act for any organization you identify. The service is intended for educators and institutional users. Students may not create independent consumer accounts.

Authorized use

You may use MasteryCue for lawful educational and administrative purposes. You are responsible for your credentials, authorized users, the legality and accuracy of submitted data, required notices or permissions, and professional review of instructional recommendations.

Prohibited use

You may not probe or bypass security, access another user’s or organization’s data, upload malicious material, reverse engineer except where law permits, resell the service without permission, use it to make solely automated high-stakes decisions about a student, or submit data you are not authorized to process.

Free trial

Eligible new educator accounts receive one 14-day free trial at account creation. No purchase is required. The trial ends without an automatic charge, and workspace access may be limited after the deadline unless you choose a paid plan. Existing subscriptions and trials retain the terms accepted when they began. Fictional sample records are for demonstration and are not saved as your students.

Subscriptions

The individual teacher plan is $12.99 per month or $99 per year, billed upfront at the selected interval. A paid upgrade starts immediately only when you choose a plan and complete checkout. Paid plans renew at the interval shown at checkout until canceled. Cancel future renewal through Billing; cancellation takes effect according to the paid subscription period. Existing Stripe trials retain their original renewal and cancellation terms, shown in Billing. Prices, taxes, refund rights, and cancellation timing are shown at purchase or in an applicable order. Stripe processes payments. District invoicing is governed by the relevant order or agreement.

School and student data

As between the parties, the school retains its rights in school data. We process it to provide and secure the service under the Privacy Policy, Student Data Commitments, and any signed data privacy agreement. We may suspend access reasonably necessary to contain a security threat or unlawful use.

Intellectual property and feedback

MasteryCue and its software, design, and original content are protected by law. You retain ownership of your materials. You grant us only the rights needed to host, process, and return them as part of the service. General feedback may be used without identifying you or disclosing confidential or student information.

Disclaimers

MasteryCue is an instructional decision-support tool. It does not replace educator judgment, official student records, legal compliance review, special-education determinations, or mandated assessment systems. To the fullest extent permitted by law, the service is provided “as is” and “as available,” without implied warranties. Some jurisdictions do not allow certain exclusions.

Limitation of liability

To the fullest extent permitted by law, MasteryCue will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, or goodwill. Our aggregate liability arising from the service will not exceed the amount paid for the service during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law or where a signed enterprise agreement states otherwise.

Indemnification

To the extent permitted by law, non-governmental users agree to defend and indemnify MasteryCue from third-party claims arising from unauthorized data, unlawful use, or violation of these Terms. This provision does not require a public agency to assume obligations prohibited by its governing law.

Governing law and disputes

Nevada law governs these Terms without regard to conflict-of-law rules, except where another jurisdiction’s law must apply. Subject to an applicable enterprise agreement and mandatory law, disputes will be brought in state or federal courts serving Clark County, Nevada. Before filing, the parties will attempt in good faith for 30 days to resolve the dispute through written notice. This section does not limit lawful regulatory complaints or emergency injunctive relief.

Termination and changes

You may stop using the service at any time. We may suspend or terminate access for material breach, nonpayment, security risk, or legal requirement, with notice when reasonably possible. We will post updated Terms and provide additional notice of material changes when required.
